Abortion Arguments Return

News website Politico leaked a draft decision on the overturning of the landmark Roe v. Wade decision. This news has brought an uproar across the country with protests and demands for change.

The opinion was circulated by Justice Samuel A. Alito Jr, as well as Justice Clarence Thomas and Justices Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett. According to the leaked document, these Justices had already voted to overturn this infamous court case after justices sided with the state of Mississippi in the case of Dobbs v. Jackson Women’s Health Organization.

In Dobbs v. Jackson Women’s Health Organization, in the state of Mississippi, a law was passed banning abortions after 15 weeks. It has been blocked by a federal judge and is currently under review by the Supreme Court. A decision is expected this June, with this information aside, this new leak has sparked much controversy.

In 1970, Jane Roe filed a lawsuit against Henry Wade who was the district attorney of Dallas Texas. Texas law stated that abortions were illegal except by doctors’ orders to save a woman’s life. Roe claimed that state laws went against her First, Fourth, Fifth, Ninth, and 14th Amendment rights.

By overturning this case, the right to have an abortion will be up to the states instead. This allows for any state to ban or allow abortions to any degree. As of now, we are unaware if this decision is set in stone.
