Brookfield, WI – A 72-year-old former treasurer of American Legion Post 449 in Brookfield has been charged with allegedly stealing tens of thousands of dollars from the organization over several years, authorities said. The theft has left the post grappling with financial difficulties as it seeks to recover the funds.

Darlene Baczek was charged by Waukesha County prosecutors with theft and unauthorized use of an entity’s identifying information. Court records indicate that the alleged theft occurred between February 2018 and June 2024, during which Baczek reportedly withdrew cash and wrote unauthorized checks from the post’s bank account.
The criminal complaint states that checks written by Baczek, often labeled “Pay to the Order of Cash,” ranged from $50 to $2,500, resulting in total losses exceeding $46,000.
“We have to try to run this place, and now we have to figure out what we’re going to do,” said Donna Feller, a member of American Legion Post 449, describing the post’s struggle after learning of the alleged theft.

Baczek was released on a $5,000 signature bond following her initial court appearance on Thursday. She is scheduled to return next month for a preliminary hearing. When approached by FOX6 News at her home for comment, Baczek walked away and declined to speak about the allegations.

Members of Post 449 say the organization was already financially struggling prior to the alleged theft. Baczek served as treasurer for several years, handling multiple responsibilities within the post.
“She was here a long time, and we don’t have the amounts or whatever happened to all of it,” Feller said. “I’d like to be reimbursed so that we can keep our place open.”
The post is now attempting to remain optimistic and hopes to recover the stolen funds to continue operations and maintain its role in the community.
